Pat & Trade Inc. provides an AI-powered platform that:

• Submits applications to patent and trademark offices worldwide
• Tracks application status and office correspondence
• Generates AI-assisted responses to office actions
• Manages documents and application lifecycle

The Service is a technology tool, not a law firm. We do not provide legal advice, legal representation, or attorney services.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use this Service. By using the Service, you represent and warrant that you meet these requirements.

To file applications on your behalf, you must grant Pat & Trade Inc. Power of Attorney. By accepting the Power of Attorney agreement:

• You authorize us to act as your representative before patent and trademark offices
• You authorize us to file applications and respond to office actions
• You acknowledge that we are NOT attorneys and do NOT provide legal advice
• You understand that you may revoke this authorization at any time

The Power of Attorney is limited to filing and administrative matters. It does not create an attorney-client relationship.

5. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Providing accurate and complete information

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

6. Fees and Payment

Service Fees

Our service fee is 10% of the official government office filing fees. This covers:

• AI-powered document formatting
• Application filing and submission
• Tracking and monitoring
• AI-assisted responses to office actions
• Platform access and support

Office Fees

You are responsible for paying all government office fees directly to the relevant patent and trademark offices. These fees vary by jurisdiction and application type.

Payment Terms

• All fees are due at the time of service
• Payments are processed securely through Stripe
• Service fees are non-refundable once applications are submitted
• Office fees are paid directly to government offices and follow their refund policies

7. Intellectual Property

Your Content

You retain all rights to your inventions, trademarks, and application materials. By using the Service, you grant us a limited license to:

• Process and format your application data
• Submit applications to patent and trademark offices
• Store and display your data within your account
• Use AI to analyze and improve formatting (data is anonymized)

Our Platform

All content, features, and functionality of the Platform are owned by Pat & Trade Inc. and protected by intellectual property laws.

No Legal Advice

WE ARE NOT ATTORNEYS. This Service does not provide legal advice or create an attorney-client relationship. Any information provided by our AI or platform is for informational purposes only.

No Guarantee of Approval

We do not guarantee that your patent or trademark application will be approved. Approval decisions are made solely by the relevant government offices.

AI Limitations

While our AI is designed to assist with formatting and responses, it may contain errors or inaccuracies. You are responsible for reviewing all submissions before filing.

Service Availability

We strive to maintain high availability, but we do not guarantee uninterrupted or error-free service. We are not liable for any downtime or service interruptions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAT & TRADE INC. SHALL NOT BE LIABLE FOR:

• Rejection of patent or trademark applications
• Errors or omissions in AI-generated content
• Missed deadlines due to system failures
• Loss of intellectual property rights
• Indirect, consequential, or punitive damages

Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Pat & Trade Inc., its affiliates, and employees from any claims arising from:

• Your use of the Service
• Your application materials or intellectual property
• Your violation of these Terms
• Your violation of any third-party rights

11. Termination

You may terminate your account at any time through your account settings. We may suspend or terminate your access if you violate these Terms.

Upon termination:

• Your access to the Platform will cease
• We will delete your personal data (unless required by law)
• Ongoing applications may continue to be processed
• Service fees are non-refundable

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

Continued use of the Service after changes constitutes acceptance of the new Terms.
